Terms of Service

1. Definitions

In these Terms of Service, the following definitions apply:

• "Service" - The Vo2Max platform, including the website, web application, APIs, and all related services operated by Zairi Aimen.
• "User" - Any individual or entity that creates an account and uses the Service.
• "Content" - Any data, text, images, videos, training programs, workouts, or other materials created, uploaded, or stored using the Service.
• "Vo2Max" - Zairi Aimen, the individual that operates the Service.

2. Our Services

2.1 Service Description

Vo2Max is a fitness and workout tracking platform that enables users to track workouts, manage training plans, and achieve their fitness goals.

2.2 Service Availability

We strive to maintain 99.9% uptime for our Service. However, we do not guarantee uninterrupted access and may perform maintenance that temporarily affects availability. We will provide reasonable notice for scheduled maintenance when possible.

2.3 Service Modifications and Active Development

Vo2Max is under active development. Features, user interface, training algorithms, integrations, pricing tiers, and availability may be added, changed, limited, or removed at any time without prior notice. We are not obligated to maintain any specific feature or functionality. Your continued use of the Service after such changes constitutes acceptance of the modified Service.

2.4 Training Disclaimer

Vo2Max provides training planning tools and educational content only. The Service does not provide medical advice, diagnosis, or treatment. Endurance training carries inherent risks of injury, illness, or adverse health events. You assume all risks associated with following any plan generated by the Service. Consult a qualified physician before beginning or modifying any strenuous training program, especially if you have a medical condition, injury, or history of cardiovascular disease.

2.5 No Guaranteed Outcomes

Training plans, load estimates, and performance projections are algorithmic estimates based on the information you provide. Vo2Max does not guarantee race results, fitness improvements, weight loss, injury prevention, or any specific physiological outcome. Individual responses to training vary widely and depend on factors outside our control.

3. User Accounts

3.1 Account Registration

To use the Service you must be at least 18 years of age and provide accurate, complete registration information. You are responsible for maintaining the security of your account credentials and for promptly updating your information when it changes.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We may suspend or terminate your account if you violate these Terms of Service, engage in fraudulent or illegal activities, fail to pay subscription fees when due, provide false or misleading information, or pose a security risk to the Service or other users.

4. Subscription & Billing

4.1 Subscription Plans

Vo2Max offers the following plans:

• Free: Basic features including 1 plan generation per day, up to 10 saved workouts, single-sport plans, and Strava/Intervals.icu sync - at no cost.
• Pro ($7.49/month or $74.99/year): Unlimited plan and workout generation, multi-sport and triathlon plans, training load analytics (ATL/CTL/TSB), and race peak & taper planning.

Feature limits and pricing are displayed on our pricing page and may be updated from time to time with reasonable notice.

4.2 Payment Processing

All payments for Vo2Max Pro are processed through our payment provider, Paddle. By subscribing, you agree to Paddle's terms of service. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, or return inquiries, you may contact Paddle at Paddle Help or as indicated in your receipt. We accept major credit cards and other payment methods as displayed during checkout.

4.3 Billing Cycle

Vo2Max Pro is billed monthly or yearly, depending on your selection at checkout. Your subscription will automatically renew at the end of each billing period unless cancelled before the renewal date.

4.4 Price Changes

We may change subscription prices at any time. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers. Your subscription will automatically renew at the new price unless you cancel.

4.5 Refund Policy

All Vo2Max Pro purchases are processed by Paddle.com, our Merchant of Record. Paddle handles payment processing, customer service inquiries, and refund requests.

Refund eligibility is governed by the Paddle Refund Policy and applicable consumer protection laws in your territory. Nothing in these Terms limits your mandatory consumer rights.

To request a refund or exercise a statutory withdrawal right, follow the instructions in the Paddle Refund Policy or use the "Manage subscription" or "View receipt" link in your purchase confirmation email. You may also visit paddle.net.

If you cancel your subscription, cancellation takes effect at the end of your current billing period unless Paddle processes an eligible refund or immediate cancellation. You will retain Pro access until the end of your current billing period.

4.6 Failed Payments

If a payment fails, we will attempt to process the payment again. If payment continues to fail, your Pro subscription may be downgraded or suspended. You are responsible for ensuring your payment information is current and accurate.

4.7 Subscription Cancellation

You may cancel your Vo2Max Pro subscription at any time through your account settings or by emailing support@vo2max.icu. Cancellation takes effect at the end of your current billing period and you will retain Pro access until that date. No further charges will be made after cancellation.

5. License Agreement

5.1 License Grant

Subject to your compliance with these Terms, Vo2Max grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or business coaching activities.

5.2 License Restrictions

You may not sublicense, sell, or transfer your access to the Service; reverse engineer, decompile, or disassemble any part of the Service; or use the Service to develop a competing product or service. You may not copy or reproduce any part of the Service without permission, use automated systems (such as bots or scrapers) to access the Service, share account credentials with unauthorized users, or circumvent any security measures or access restrictions.

5.3 Intellectual Property

The Service, including all software, design, text, graphics, and other content, is owned by Vo2Max and protected by copyright, trademark, and other intellectual property laws. You retain ownership of the Content you create using the Service.

6. Acceptable Use

6.1 Prohibited Activities

When using the Service you agree not to violate any applicable laws or regulations, infringe on the rights of others, or upload malicious code or content. You may not harass, abuse, or harm other users, impersonate any person or entity, interfere with the proper operation of the Service, attempt to gain unauthorized access to the Service or other accounts, or use the Service for any illegal purpose.

6.2 Content Standards

All Content you create or upload must not be defamatory, obscene, or offensive; promote illegal activities; infringe on intellectual property rights; contain personal information of others without consent; or contain malware, viruses, or harmful code.

7. Data & Content

7.1 Your Content

You retain ownership of all Content you create using the Service. By using the Service, you grant Vo2Max a limited license to host, store, and display your Content as necessary to provide the Service.

7.2 Data Security

We implement industry-standard security measures to protect your data. However, no method of transmission or storage is 100% secure. You acknowledge and accept the inherent risks of transmitting data over the internet.

7.3 Data Export

You may export your Content at any time through the Service's export features. Upon account termination, you will have a limited period to export your data before it is deleted.

7.4 Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

8. Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VO2MAX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF THE CAUSE OF ACTION.

8.3 Maximum Liability

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

8.4 Professional Advice

The Service is a tool for fitness planning and does not constitute medical, health, nutritional, or professional coaching advice. Users are solely responsible for ensuring their use of the Service is appropriate for their circumstances. Vo2Max is not responsible for any injuries, health issues, or losses that may result from use of the Service or reliance on generated plans.

8.5 Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be addressed by contacting us at support@vo2max.icu. If the dispute cannot be resolved informally within 30 days, it shall be resolved exclusively in the courts of Oran, Algeria, and you consent to the personal jurisdiction of those courts. To the extent permitted by applicable law, you waive any right to participate in a class action or representative proceeding against Vo2Max.

9. Termination

9.1 Termination by You

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will retain access to the Service until that time.

9.2 Termination by Us

We may terminate or suspend your account immediately if you violate these Terms. We may also terminate inactive accounts or accounts without paid subscriptions after a period of inactivity.

9.3 Effect of Termination

Upon termination your license to use the Service immediately ends and you must cease all use. You will have a limited period to export your Content; after that period your Content may be deleted. Provisions that by their nature should survive termination will remain in effect.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 15 days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the new Terms.
